I DEFINITIONS

  1. Controller – Tardion Yachts Damian Osinko, VAT ID: 8132781079
  2. Personal Data – any information relating to an identified or identifiable natural person, identified directly or indirectly by reference to one or more specific factors determining physical, physiological, genetic, mental, economic, cultural or social identity, including device IP address, location data, online identifier, and information collected via cookies or other similar technologies.
  3. Policy – this Privacy Policy.
  4. GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.
  5. Service – the website operated by the Controller at tardion.com.
  6. User – any natural person visiting the Service or using one or more services or functionalities described in the Policy.

II DATA PROCESSING IN CONNECTION WITH THE USE OF THE SERVICE

  1. When using the Service, the Controller collects data necessary for commercial contact as well as information about the User’s activity in the Service through cookies. Detailed rules and purposes of processing personal data collected during the User’s use of the Service are described below.

III PURPOSES AND LEGAL GROUNDS FOR DATA PROCESSING IN THE SERVICE

USE OF THE tardion.com SERVICE

  1. Personal data of all persons using the Service (including IP address or other identifiers and information collected via cookies or similar technologies), who are not registered Users, are processed by the Controller:
    • for the purpose of providing electronic services, including making content available to Users and providing contact forms – the legal basis is the necessity to perform a contract (Article 6(1)(b) GDPR);
    • for marketing purposes of the Controller and third parties, in particular related to behavioural advertising – principles are described in the “MARKETING” section.
    • User activity in the Service, including personal data, is recorded in system logs. The information collected is processed for service provision and technical purposes, including ensuring security, system integrity, backups, testing, detecting irregularities, and protection against abuse or attacks.

CONTACT FORMS

  1. The Controller enables contact via electronic contact forms. Using the form requires providing personal data necessary to contact the User and respond to the enquiry. Providing mandatory data is required; other data is optional.
  2. Personal data are processed:
    • to identify the sender and handle the enquiry – legal basis: necessity to perform a service contract (Article 6(1)(b) GDPR).

MARKETING

  1. The Controller processes personal data for marketing purposes and may use profiling (e.g. remarketing). This involves automated processing to evaluate selected factors to analyse behaviour or forecast future preferences.

IV COOKIES AND SIMILAR TECHNOLOGIES

  1. Cookies are small text files stored on the User’s device to facilitate website usage, such as remembering visits and actions.

  1. The Controller uses service cookies to provide electronic services and improve their quality, including:

  1. Marketing cookies are used for behavioural advertising. Their use requires User consent, which can be withdrawn at any time via browser settings.

V DATA RETENTION PERIOD

  1. Data retention depends on service type and purpose. Data is processed until consent is withdrawn or an objection is raised.
  2. Retention may be extended to establish or defend legal claims. After that, data is deleted or anonymised.

VI USER RIGHTS

  1. Data subjects have the right to information, access, rectification, erasure, restriction, data portability, objection, withdrawal of consent, and lodging a complaint with the supervisory authority.

VII DATA RECIPIENTS

  1. Personal data may be disclosed to external service providers, including IT, legal and affiliated entities.
  2. Data may be disclosed to authorities based on legal obligations.

VIII DATA TRANSFER OUTSIDE THE EEA

  1. The Controller does not transfer data outside the EEA.

IX DATA SECURITY

  1. The Controller applies appropriate technical and organisational measures to ensure data security.
  2. Subcontractors are required to apply equivalent security measures.
